JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 25.03.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner is said to have committed rape upon the informant who happens to be minor girl.

The contention on behalf of the petitioner is that medical report does not support the allegation and, as a matter of fact, petitioner has been roped in this false case on account of land dispute and enmity.

Regard being had to the facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail. Accordingly, his prayer for bail in connection with Begusarai SC/ST P. S. case no. 64/2014 (POSCO- 01/15) pending in the court of the Addl.

Patna High Court Cr.Misc. No.12196 of 2015 (2) dt.25-03-2015 Sessions Judge I-cum- Special Judge (POSCO) Act, Begusarai stands rejected.

However, the concerned court should expedite trial of the petitioner.
