JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 23-06-2015 Heard learned counsel for the petitioner as well as learned APP for the State.

Two unknown persons came to the wine shop where informant along with others were salesmen, asked for beer and there was an altercation amongst them over payment of price and during course thereof, one of them shot at causing injury over informant. From the order impugned, it is apparent that petitioner along with one Vikash Kumar Singh was apprehended in connection with Barun PS Case No.205/2014 whereunder they made inculpatory extra-judicial confessional statement and further admitted their involvement along with Rahul S/O Motilal in the present case as well as disclosed that Vikash Kumar Singh to be assailant. Furthermore, from the order impugned, it is also apparent that the learned lower court had itself admitted that there happens to be no direct evidence

Patna High Court Cr.Misc. No.15768 of 2015 (3) dt.23-06-2015 against the petitioner save and except the criminal antecedents. In the aforesaid facts and circumstances of the case, petitioner, Rahul Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun PS Case No. 208/2014.
