The petitioner is not claiming Plot No.2689 and so far as Plot No.2737 is concerned, it is stated in the counter affidavit that encroachment has been vacated except the land of Purcha holders including the petitioner.
Since there is no question of removal of encroachment from that part of Plot No.2737 which belongs to the petitioner in view of statement made in the counter affidavit, he does not want to prosecute the matter further.
