Patna High Court CWJC No.6518 of 2018(2) dt.10-04-2018 2/3 "(i) For direction upon the respondent university to conduct first and second year examination for B.
Ed (ODL mode) course for the session 2016-18.
(ii) For direction upon the concerned respondents to approve the regulation sent by the university to the Hon'ble Chancellor in this regard.
(iii) For a further direction upon the respondent UGC to grant approval to the B. Ed (ODL) course conducted by the directorate of distance education (BRA) university, Muzaffarpur, if any required.
(iv) For any other relief/reliefs for which the petitioners are found entitled to."
The petitioners claim that they are students of B. Ed (ODL mode) course for the sessions 2016-18, run by the Director of Distance Education of B. R. A. Bihar University, Muzaffarpur.
It is evident from the pleadings in the writ application that without there being regulation in place, the petitioners have taken admission in the said course. It is the petitioners' case that the draft regulation is pending in the Office of the Chancellor,
Patna High Court CWJC No.6518 of 2018(2) dt.10-04-2018 3/3 Universities of Bihar, for approval.
Whether any examination for the said course is to be conducted or not will certainly depend on the decision of the Chancellor to be taken in respect of the approval of the regulation, which is pending.
This application is, accordingly, disposed of with an observation that let a decision be taken by the Office of the Chancellor in respect of approval of the draft regulation, if the same has been sent and is pending.
The Court, however, indicates that while taking any decision on approval of draft regulation for B. Ed. Course in question, it will have to be kept in mind, whether or not the B. Ed. Course can be allowed to be undertaken through distance education mode.
