The petitioners have preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code.

As per allegation in the FIR, the five named accused persons are stated to have assaulted the nephew of the informant with brick, stone etc. leading to his death.

It is submitted by learned counsel for the petitioners that there is an unexplained delay of four days in lodging of the FIR. The allegations are general and omnibus in nature. No

Patna High Court CR. MISC. No.12497 of 2021(3) dt.03-08-2021 2/2 information was given to the police station. The nephew was not taken to the doctor for treatment. The petitioners are in custody since 18.8.2020 and have no criminal antecedent. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the direct allegations against the petitioners in the FIR which is supported from the contents of the postmortem report, the Court is not inclined to enlarge the petitioners on bail and the application is rejected.
