The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 506, 384, 385, 379, 420, 353, 188 of the Indian Penal Code, Rule 11 and 56(i) of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation and Storage) Rule, 2019 and Section 15 of the Environmental Protection Act. It is a case of illegal extraction of sand on the instructions of this petitioner.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.2737 of 2022(3) dt.01-08-2022 2/2 petitioner that petitioner has falsely been implicated in this case. The petitioner is neither owner of the seized tractor nor at his instructions illegal extraction of sand was done. Moreover, other similarly situated co-accused person has been granted privilege of bail by this Hon'ble Court vide Cr. Misc. No. 3943 of 2022.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara in connection with Sandesh P.S. Case No. 84 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
