JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 11.03.2015 in a case registered for the offences punishable under section 363, 366(A) of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that for the incident first information report was lodged after one and half months. In her statement under section 164 of the Cr. P. C the victim got recorded her age as 19 years. The court also assessed her age as such whereas the medical report suggested her age between 16-17 years. In her statement under section 164 of the Cr. P. C the

Patna High Court Cr.Misc. No.16911 of 2015 (3) dt.22-06-2015 2/2 victim stated that she went with the petitioner to Hilsa with her own free will and performed marriage and wants to reside with the petitioner as his wife.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Nagarnausa P. S. case No.35 of 2015.
