The petitioner seeks bail in a case under Section 302 and other Sections of the I.P.C.
The informant alleged that the petitioner assaulted Om Prakash Yadav the brother-in-law of the informant. Om Prakash Yadav fell down. Thereafter, Upendra Yadav assaulted the fatherin-law of the informant with axe on his leg and the father-in-law of the informant fell down. Thereafter all the accused persons assaulted Yogendra Yadav and Om Prakash Yadav. It is submitted that no specific allegation of assault is made against the petitioner but from perusal of the post mortem report it appears that Yogendra Yadav got as many as nine injuries
Patna High Court Cr.Misc. No.10397 of 2015 (6) dt.30-06-2015 2 / 2 on different parts of his body. All vital parts of the deceased were damaged on account of assault made by the petitioner and other accused persons.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected in Belhar P.S. Case No. 147 of 2014, G.R. No. 1666 of 2014, pending in the court of the learned J.M. Banka. The Trial Court is directed to expedite the trial and conclude the same within one year from the date of receipt of this order.
