The petitioner is languishing in custody since 27.12.2014 in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code. It is alleged against the petitioner that he assaulted with sword on the head of Sanjeev Choudhary, the injury has been found to be grievous. It is submitted by learned counsel for the petitioner that there is no accusation of repeating the blow hence the case does not come with the purview of Section of the I.P.C.

There is counter version of occurrence also and petitioner's side have also received injuries. A statement has been made in paragraph no.3 of the petition that the petitioner has no criminal

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Vaishali at Hajipur in connection with Jandaha P.S. Case No. 56 of 2014.
