Petitioner is languishing in custody since 17.06.2016 in a case registered for the offences punishable under Sections 20, 22, 23 of the Narcotics Drugs and Psychotropic Substances Act.
The prosecution case is that on the information that co-accused Bajrangi Rai deals in trade of ganja and for whom the petitioner has brought ganja from Nepal. The raid was conducted and from the possession of the petitioner and co-accused Bajrangi Rai 8.8 K.g ganja was recovered. It is submitted by the learned counsel for the petitioner that recovery has been made from the joint possession. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.35628 of 2016 (2) dt.24-08-2016 Considering the fact that accusation is of bringing ganja from Nepal and the petitioner being resident of Nepal, this Court is not inclined to grant bail to the petitioner at present in connection with Parihar P.S. Case No. 83 of 2016, pending in the court of learned Special Judge, Sitamarhi. Accordingly, the prayer for bail is rejected.
It is expected from the investigating agency to conclude the investigation.
It is also expected from the learned court below to make all efforts to conclude the trial after conclusion of investigation.
