JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 28-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioner seeks bail in connection with Baheri P.S. Case No.109 of 2016 registered under Sections 302/34 of the Indian Penal Code.

The accusation is that on 15.06.2016, Ram Udgar Yadav, the husband of the informant, had gone to the sasural house of his daughter but he did not return till late night. On the next morning, the informant came to know about lying of one dead body in the field of Rajendra Yadav. Thereafter, the informant went there and saw the dead body of her husband sustaining grievous injuries. Before some days, Ram Pratap Yadav, the father of her daughter-

Patna High Court Cr.Misc. No.22980 of 2017 (4) dt.28-06-2017 2/2 in-law, had given threatening to her brother Pawan Yadav to kill her husband. The daughter-in-law of the informant had illicit relation with the petitioner and the petitioner also used to give threatening to her husband. The father of the daughter-in-law of the informant had lodged the case about her missing and after lodging of the case, the husband of the informant used to conceal himself.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is the co-villager of the informant and has falsely been implicated in this case on mere suspicion. The petitioner having no criminal antecedent is in custody since 26.03.2017 and, on investigation, the chargesheet has already been submitted against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Darbhanga at Laheriasarai, in connection with Baheri P.S.
