JUSTICE MUNGESHWAR SAHOO ORAL ORDER 19-01-2016 Learned counsel appearing on behalf of the appellant submitted that in fact while disposing of this First Appeal by the order dated 21.04.2010 by mistake cross objection was not disposed of which was filed by the respondents. In view of the submissions, perused the order dated 21.04.2010. Admittedly the cross objection was filed prior to the said order dated 21.04.2010 by the cross objection respondent. From perusal of the said order, it appears that this Court disposed of this First Appeal on the ground that the First Appeal is covered by the judgment delivered in First Appeal No. 668 of 1980 and other connected appeals. Therefore, the present appeal and other connected appeals were disposed of in terms of the judgment passed in First Appeal No. 688 of 1980. Since the judgment has

Patna High Court FA No.714 of 1980 (27) dt.19-01-2016 2/2 been passed on merit, there is no question of pendency of the cross objection arises. It will impliedly mean that the cross objection was also disposed of. Accordingly the said cross objection stands disposed of.
