The petitioner seeks bail in a case registered under section 307 and other sections of the Indian Penal Code and later on section 302 I.P.C was also added.

The deceased is the informant. The informant alleged that he was coming after closing his wine shop, Gultan, Bhola Kumar, Bali, Manish Mahto and Santosh Yadav came there and asked him that why he was not giving wine to them free of cost. The informant replied but in the meantime on the order of Manish Mahto, Gultan fired which hit on the chest of the informant. Sanjay a staff of the shop brought the informant to the P.M.C.H.

It is submitted that petitioner is of course named

Patna High Court Cr.Misc. No.11266 of 2015 (2) dt.18-03-2015 2/2 in the first information report but no specific overt act is alleged against the petitioner and petitioner is in jail since 23.01.2014. Considering the fact that petitioner is named in the first information report but allegation of firing is made against Gultan and no overt act is alleged against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional District Judge-IV, Patnacity in S.Tr. No. 362 of 2014 arising out of Chowk P.S. Case No. 192 of 2013.
