Perused the record.

The appellant has filed this appeal against the judgment and decree passed by 5th Additional Sub-Judge, Patna in Money Suit No. 116 of 1971/10 of 1979. The suit of plaintiff against the State of Bihar was dismissed with cost. This appeal is running for hearing. The appellant has left taking interest and for his appearance, a registered notice dated 11.04.2017 was issued. More than 30 days have already passed over. It appears that the appellant has no interest in prosecuting this case.

In the facts and circumstance of the case, this appeal is dismissed.
