2. The petitioner is in custody since 31.01.2016 in connection with Rupaspur P.S. Case No. 24 of 2016 for the offences alleged under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. It is submitted that the petitioner has been falsely implicated and there is no recovery from the possession of the petitioner. Similarly situated accused Ajay Kumar has been granted bail by this Court.

4. Considering the period of custody undergone by the petitioner who claims to have clean antecedents, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to

Patna High Court Cr.Misc. No.24902 of 2016 (3) dt.25-07-2016 the satisfaction of learned Additional Chief Judicial Magistrate-II, Danapur (Patna) in connection with Rupaspur P.S. Case No. 24 of 2016, subject to the conditions that one of the bailors will be a close relative of the petitioner; and the petitioner shall remain physically present on each and every date during trial and in the event of failure to do so on three consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned.
