This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Karakat PS Case No. 148 of 2014 for the alleged offence punishable under Sections 328, 379 and later on Section 395 of the Indian Penal Code.

Referring to the prosecution case, learned counsel representing the petitioner submits that petitioner was suspected by the furniture shopkeeper that petitioner was accompanying the victim and he believed that the vehicle along with mobile phone and Rs.2500/- was taken away by the petitioner. Learned counsel for the petitioner submits that there is inordinate delay in lodging the FIR. The instant case was instituted on

Patna High Court Cr.Misc. No.4305 of 2019(2) dt.29-01-2019 2/2 17.07.2104 whereas FIR was lodged on 19.07.2014. He further submits that petitioner has no criminal antecedent and he is in custody since 10.05.2018.

Considering the fact that the petitioner has no criminal antecedent and he has remained in custody for nearly nine months, this application is allowed. Accordingly, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shree Amit Kumar, Judicial Magistrate 1st Class, Bikramganj, District- Rohtas in connection Karakat PS Case No. 148 of 2014.
