====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 30-06-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 420, 406 and 409/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a lady and is a person with clean antecedent and is a senior citizen.

The informant alleges that the FIR was instituted on the direction of the B.D.O. against the named accused persons as they defalcated the government money and misappropriated the same for their personal use while carrying out Nal-Jal Yojna scheme.

Learned counsel for the petitioner further submits that petitioner is not named in the FIR, as such, no aspersion or

Patna High Court CR. MISC. No.1986 of 2022(3) dt.30-06-2022 2/2 allegation was cast against the petitioner. It is next submitted that during the course of investigation, the name of the petitioner transpired only because she was member of ward no. 7.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the fact that the petitioner is a lady and is not named in the FIR and the nature of allegation as alleged in the FIR, the petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Tariyani Chhapra P.S. Case No. 03 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
