The petitioner seeks bail in a case under Sections 25(1-B)(a) and 35 of the Arms Act.

The police got secret information that the accused persons, who made firing, hid themselves in the house of Mangal Singh. One Gangesh Kumar Singh was apprehended and two other persons managed to flee away.

It is submitted that nothing has been recovered from the possession of the petitioner. The petitioner was not even arrested on the spot. Gangesh Kumar Singh has already been enlarged on bail vide order passed in Cr. Misc. No. 7797/2004. The petitioner is in jail since 25.12.2013. The petitioner has already remained in jail for one year and three months. Considering the facts aforesaid, the above named

No.8956 of 2015 (2) dt.26-03-2015 2/2 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Vaishali in Mahnar P.S. Case No. 99 of 2003.
