JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 23-01-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seek pre-arrest bail in connection with Bidupur P.S. Case No. 149 of 2018 registered under Section 364 read with 34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that the petitioners are innocent and they have been implicated in this case due to previous enmity. Two civil suits relating to land dispute had been instituted by the petitioners' father against Chalitar Singh and Umashankar Singh bearing Civil Suit Nos. 861 of 2014 and 1155 of 2017 respectively and the present case is a by product of the civil suits only with an intention to create pressure on the petitioners. He further contended that co-accused Paramhansh
Patna High Court Cr.Misc. No.2927 of 2019(2) dt.23-01-2019 2/2 Singh @ Paramhansh Nr. Singh having identical allegation has already been granted pre-arrest bail by a Bench of this Court vide order dated 19.12.2018 passed in Cr. Misc. No. 69127 of 2018.
Learned counsel for the State does not dispute the fact that Paramhansh Singh @ Paramhansh Nr. Singh has already been granted pre-arrest bail by this Court. Considering the allegations made in the FIR and the submissions made above, in the event of arrest or surrender before the court below, the petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 149 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
