The petitioner has prayed for regular bail in a case instituted for the offence under Sections 385, 387 and 34 of the Indian Penal Code.

The allegation against the petitioners along with another is of threatening the informant on mobile to withdraw case, otherwise they will kill her along with her family members.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to dirty village politics. He has committed no offence. Petitioner is not named in the FIR. He submitted that the petitioner was arrested by the police, after chasing in Excise Act and at that

No.3857 of 2023(3) dt.01-05-2023 2/2 time petitioner was thrown his mobile, which was said to be used in threatening to the informant and his family members in the present case, but he was not lodged any either FIR or Sanha because, he was caught by the police in connection with Mansi P.S. Case No. 14/2022 and since he is in jail. He is languishing in judicial custody since 07.08.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Khagaria in connection with Suppl. Morkahi P.S. Case No. 19 of 2022.
