====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 14-02-2025 Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in a case registered for the offences punishable u/s 115(2), 126(2), 109, 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.
3. All the FIR named accused persons including the petitioner in furtherance of their common intention armed with deadly weapons are said to have assembled and on the order of co-accused Dharmdev Singh, co-accused Virendra Kumar resorted firing which hit at left knee of the informant. Petitioner also resorted firing which got misfired. The reason behind the occurrence is said to be land dispute.
4. It is submitted by learned counsel for the petitioner that
Patna High Court CR. MISC. No.1958 of 2025(2) dt.14-02-2025 2/3 petitioner is quite innocent and has committed no offence. No such occurrence as alleged has ever taken place. He has falsely been implicated in this case due to ulterior motive. The allegation levelled against the petitioner is totally false and based on concocted facts. Nothing specific has been attributed against the petitioner. Both the parties are agnates and there is admitted land dispute between them. Though there is allegation of resorting firing against the petitioner, but the same got misfired and nobody has sustained any injury, which is also evident from the FIR itself. Similarly situated co-accused has been enlarged on anticipatory bail by this court vide order dated 13.11.2024 passed in Cr. Misc. No. 76868 of 2024. Learned counsel further submits that petitioner has five criminal antecedents and he has been languishing in jail since 28.09.2024.
5. Learned APP for the State as well as learned counsel for the informant opposes the prayer for bail.

Considering the arguments of the parties as well as the fact that similarly situated co-accused has been granted anticipatory bail by this Court, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of
