1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 354, 504/ 34 of the Indian Penal Code.

3. The learned counsel for the petitioner submits that the petitioner is a woman and a person with clean antecedent and from perusal of the allegation, as alleged in the F.I.R., it would manifest that the allegation of assault is general and omnibus in nature as it is alleged by the informant that the petitioner and her husband assaulted

Patna High Court CR. MISC. No.3973 of 2024(2) dt.13-02-2024 2/2 him. It is next submitted that even presuming what has been alleged in the F.I.R. is true without admitting then the injury suffered by the injured is simple in nature.

4. The Learned A.P.P. for the State opposes the anticipatory bail application of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner and the fact that the petitioner is a woman, the petitioner, above named, in the event of her arrest or surrender before the court below within a period of six weeks, is directed to be released on bail on furnishing bail bond of Rs. 5,000/- (Five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhojpur at Arrah in connection with Sandesh P.S. Case No. 179 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
