The petitioners seek their bail in a case registered under Sections 302 and 34 of the IPC.

The informant, father of the deceased Ravindra Kumar, alleged that the petitioners and others brought his son (driver) to Village Piar for the marriage of Anand Kumar. The informant alleged that the petitioners and other persons killed his son by strangulating him.

It is submitted that the informant is not an eye witness of the occurrence and he has not disclosed the source of information. During the course of investigation, none of the witnesses have stated about the fact that the petitioners killed Ravindra Kumar. After more than three months of the occurrence, one Rajesh Singh (in para-81 of the case diary), said that the deceased, petitioners and other took the deceased to Piar Chowk and in the next morning, the informant came to know about the death of the driver of the vehicle.

Patna High Court Cr.Misc. No.6022 of 2015 (4) dt.05-05-2015 2/2 Learned counsel for the informant, submits that the witnesses saw the deceased with the petitioners. Nobody saw the petitioners killing the deceased.

Considering the facts aforesaid, the petitioners, named above, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Suvash Kumar Roy, Judicial Magistrate, Is Class, Muzaffarpur in connection with Piar P.S.Case No. 35 of 2014.
