The petitioner is in custody since 29.10.2014 in connection with Hussainganj P.S. Case No. 281 of 2014 registered for the offence under section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner has been arrested way back in the month of October, 2014, but till date petitioner has not been put on T.I. Parade. It is further submitted that the alleged recovery was not made from the possession of the petitioner rather it was recovered from the possession of one Munna Kumar Pandey, who was caught red handed on the spot. It is further submitted that the Laptop and cash was recovered from the possession of said Munna Kumar Pandey.

Patna High Court Cr.Misc. No.11657 of 2015 (4) dt.26-05-2015 It is further submitted that name of the petitioner has been taken by said Munna Kumar Pandey with whom; he had some dispute regarding payment of dues for repair of his motorcycle. Considering the aforesaid submissions and also the fact that the petitioner has no criminal antecedents, let the petitioner, as mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Hussianganj P.S.
