JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner as well as learned APP for the State.
On getting confidential information, a raid was conducted and during course thereof, 919 litres of spirit/country made wine were recovered having been concealed beneath the earth. Furthermore, Laxman Manjhi, Muklesh Manjhi, Ravan Manjhi, Sona Devi, Surendra Mahto (petitioner) were identified having been engaged in such illegal activities. However, none of them was present at the spot when the raid was conducted. Accordingly, Surendra Mahto is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Amrendra Prasad, Judicial Magistrate-1st Class, Chapra in connection with Amnour PS Case No. 77/2016.

No.27496 of 2016 (2) dt.12-07-2016 However, considering the criminal antecedents of petitioner, more particularly, relating to excise case, petitioner will have to undertake at his end that henceforth, he will not engage in such kind of activity and if so found, his bail bond will stand cancelled.
