JUSTICE SUDHIR SINGH ORAL ORDER 05-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 328,304 (B)/34 of the Indian Penal Code. The allegation against the accused persons including the petitioner is of killing the daughter of the informant for non fulfillment of demand of dowry.
It is submitted on behalf of the petitioner that the petitioner is in custody since 05.04.2016.Charge sheet has already been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering of the witnesses against the petitioner. From perusal of paras 8,9,10, 46 and 47 of the case diary it is evident that the petitioner had gone for treatment of his nephew, which was not liked by his wife and she
Patna High Court Cr.Misc. No.23472 of 2016 (4) dt.05-08-2016 2/2 committed suicide. At best it is a case under Section 306 IPC. On behalf of the Statd, it is submitted that the petitioner is named in the FIR.
In the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with Barahara (Raghuvans Nagar) P.S.Case No. 107 of 2014.
