The petitioners have preferred this application for grant of regular bail in a case registered under sections 272, 273, 420 and 120B of the Indian Penal Code and sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016. As per allegations in the FIR, 4654 litres of liquor was recovered from the truck of which the petitioners were the driver and khalasi.

It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. They were engaged as driver and khalasi and had no knowledge

Patna High Court CR. MISC. No.11867 of 2021(4) dt.02-09-2021 2/2 about the contents of the goods loaded. They are in custody since 17.11.2020 and have no criminal antecedents. Investigation in the case has concluded.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioners not having any criminal antecedent, the petitioners are directed to be enlarged on bail in connection with Special Case no. 335 of 2020 (arising out of Kishanganj P.S. Case no. 430 of 2020) on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge II, Kishanganj.
