This is a petition for grant of regular bail for offence under Sections 109, 170 and 120B of the Indian Penal Code and 7, 8, 11, 12, 13, 18 and 21 of the Prevention of Corruption Act, 1988. The petitioner was apprehended by the police when the petitioner was attempting to pay bribe of Rs.32,000/- along with a cheque of Rs.25,000/- to the police to allow the petitioner for illegal mining of sand.

Submission of the learned counsel for the petitioner is that the petitioner is in custody since 21.02.2017, investigation is already compete, the petitioner has got no criminal antecedent and there is no material that the petitioner is going to tamper with the evidence. More over, the petitioner has falsely been implicated as the petitioner failed to satisfy the extraneous demand of the police.

On the other hand, the learned counsel for the Vigilance submits that serious allegation is there supported by material on record against the petitioner.

Considering the entire facts and circumstances of this

Patna High Court Cr.Misc. No.24111 of 2017 (3) dt.28-06-2017 2/2 case, let the petitioner, above named, be released on bail, on completion of six months' custody, on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Anti P.S. Case No. 8 of 2017 corresponding to Special Case No. 7 of 2017 to the satisfaction of the Special Judge, Vigilance, I, Patna, or successor Court with the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the bail bond of the petitioner shall be cancelled by the Court below itself.
