JUSTICE SUDHIR SINGH ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 420, 421, 467, 468 and 120B of the Indian Penal Code. Allegation against the petitioner is that he was involved in the conspiracy and he cheated public by taking their money. It has been submitted on behalf of the petitioner that he is in custody since 8.4.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of evidence is alleged against the petitioner. Petitioner has been made accused due to mistake of fact. Petitioner is an employee in the company in question. No wrongful loss or no wrongful gain has been caused by the petitioner. Other co-accused has been granted bail vide Cr. Misc. no. 26024 of 2016.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, , let the above named petitioner be released on bail on furnishing bail

Patna High Court Cr.Misc. No.24954 of 2016 (4) dt.08-08-2016 2/2 bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad (Bihar), in connection with Aurangabad (T) P.S. Case no. 118 of 2016.
