The petitioner is languishing in custody for the offences punishable under Sections 385/387 of the Indian Penal Code.

Allegation is of demand of ransom on mobile call. The caller disclosed his name as petitioner.

Submission is that the said mobile was not of the petitioner nor the petitioner demanded any ransom. Both the allegations are triable by the Magistrate. Only on the basis of his criminal antecedents the petitioner has been roped in this case.

Considering the facts aforesaid, let the petitioner,

Patna High Court CR. MISC. No.12054 of 2021(3) dt.27-09-2021 2/2 above named, who is in custody since 06.07.2020, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Riga P.S. Case No.125 of 2016 with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
