====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks regular bail in connection with Daniyawan P.S. Case No. 169 of 2018, G.R. No. 6865 of 2018, registered for the offence punishable under Sections 323, 341, 307 and 34 of the Indian Penal Code and Section 27 of Arms Act.

Allegation against the petitioner as per FIR is that he was involved in firing by pistol on the shoulder of the informant which caused grievous injury.

Submission of the learned counsel for the petitioner is that the injuries are superficial. The Doctor, who issued the Injury Report, has retired and submitted his report after retirement. There is case and counter case between the parties on account of land dispute. The petitioner is in custody since 26.10.2019.

Patna High Court CR. MISC. No.316 of 2020(4) dt.24-02-2020 2/2 Heard learned A.P.P. for the State as well as learned counsel for the informant, who submits that the petitioner is also made accused in two other cases with respect to which supplementary counter affidavit has also been filed. From the injury report, which is a part of the case diary, it appears that a penetrating entry wound was found and an exit wound was also found.

Considering the submissions of the parties and in view of the facts and circumstances of the case, I am not inclined to grant regular bail at this stage. Accordingly, this application is disposed of. (Vinod Kumar Sinha, J) uma/- U T
