====================================================== CORAM: HONOURABLE MR. JUSTICE SOURENDRA PANDEY ORAL ORDER 12-05-2025 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the State.

2. The petitioner seeks regular bail in connection with Khirimore P.S. Case No. 119 of 2024, registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code. Petitioner has one antecedent.

3. The prosecution case is to the effect that the informant had given a written application, stating therein that on 16.06.2024, he received a call from his son-in-law (petitioner), informing him that his daughter had committed suicide. The informant thereafter reached the house of his daughter and found her lying dead on the bed and subsequent thereto he had alleged that his daughter had been done to death for non-

4. The learned counsel for the petitioner submits that the petitioner being the husband has falsely been implicated in this case and totally false and fabricated story has been concocted by the informant. Learned counsel further submits that from perusal of the postmortem report, it is evident that the cause of death is due asphyxia as a result of hanging. It has further been submitted that the witnesses examined during the course of investigation, have stated that the wife of the petitioner had committed suicide and her body was brought down from the fan with the help of independent co-villagers. Lastly, learned counsel submits that the petitioner has one antecedent and he is in custody since 27.09.2024

Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail and has stated that the petitioner is the husband of the deceased and it was the petitioner and his family member who had tortured the deceased for non-fulfillment of demand of dowry and later she was killed.

6. Considering the aforesaid submissions made by the respective parties and taking into account the statement of independent witnesses as also the statement of old brother of the deceased and also considering the fact that the petitioner is in

Patna High Court CR. MISC. No. 2390 of 2025(4) dt.12-05-2025 3/3 custody since 27.09.2024, I am inclined to grant the petitioner privilege of regular bail.

7. Accordingly, the prayer for bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Chief Judicial Magistrate, Danapur, Patna, in connection with Khirimore P.S.
