JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be father-in-law of the deceased. The deceased died within two years of her marriage at her matrimonial home. There is allegation that petitioner and other F.I.R named accused used to torture the deceased due to non fulfillment of illegal demand. The dead body of deceased was buried in Badhar from where the dead body of the deceased was exhumed. The post mortem report of the deceased reveals that some injuries were found on her person and cause of death of deceased was asphyxia due to pressure over nose and mouth. Therefore, the aforesaid finding of the doctor goes to show that deceased was killed within the four wall of the house of the

Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to grant privilege of bail to the petitioner and hence, his prayer for bail in connection with Udawant Nagar P.S.case No. 165 of 2015, pending in the court of learned Chief Judicial Magistrate, Bhojpur at Ara stands rejected.
