JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 02.08.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.
Earlier prayer for bail of the petitioner was rejected by this court taking note of this fact that deceased died within seven years of her marriage due to alleged torturing on account of non-fulfillment of illegal demand of dowry. However, trial court has reported that out of twelve prosecution witnesses, five prosecution witnesses have already been examined and learned trial court has sought four months' time to conclude the trial of the petitioner.
Considering the report of the trial court, I am not inclined to release the petitioner on bail and, again, his prayer for bail in connection with Session trial no. 607/2016 arising out of Malsalami P.S. Case no. 51/2016 pending in the court of Addl. Sessions Judge VII, Patnacity, Patna stands rejected.
