2. The petitioner is apprehending his arrest in connection with Sheikhpura (Mahila) P.S. Case No. 22 of 2015 for the offence under sections 147, 148, 149, 452, 346, 323 and 376(D) of the I.P.C. lodged on 03.07.2015 by the informant, Renu Devi.

3. A perusal of the F.I.R. would show that Sheikhpura (Mahila) P.S. Case No. 22 of 2015 was lodged under Sections 147, 148, 149, 452, 346, 323 and 376(D) in which, the complainant/informant alleged that while she was at home with her children and in-laws, the accused came and assaulted her as also was gang raped, accordingly, she was moved to the sadar hospital and the F.I.R.

4. It is surprising that in a 2015 year case that too

Patna High Court CR. MISC. No.5171 of 2024(3) dt.16-04-2024 2/2 where Section 376(D) of the Indian Penal Code is incorporated, the petitioner is roaming free for the last 9 years and at will has come to this Court for grant of anticipatory bail.

5. The same is accordingly rejected.

6. The Superintendent of Police (S.P.) Nalanda, Biharsharif shall submit a report how steps not taken against this petitioner for the last 9 years.

7. The report to come within a period of four weeks from today.

8. Let a copy of this order be communicated to the Superintendent of Police (S.P.) Nalanda, Biharsharif through FAX or e-mail for its forthwith compliance.
