JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 05.07.2014 in a case registered for the offences punishable under Section 414/34 of the Indian Penal Code and 25(1-B) (a)/26/35 of the Arms Act.

It is alleged that from the possession of the petitioner one loaded pistol with live cartridge and mobile were recovered whereas stolen motorcycle was recovered from the possession of the petitioner and co-accused Rupesh Kumar Singh. It is submitted by learned counsel for the petitioner that petitioner is roped in several cases but in most of the cases the petitioner is not named and has subsequently roped and in all the cases the petitioner is on bail.

Considering the period under custody, let the above

No.15266 of 2015 (3) dt.23-06-2015 2/2 named petitioner be released on bail, on furnishing bail bonds of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Chatouni P.S. Case No. 119 of 2014.

Considering the serious criminal antecedent, learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions or gets involved in some serious nature of offences.
