The petitioner is apprehending his arrest in connection with Jagdishpur P.S.Case No.309 of 2018 dated 12.8.2018 registered in Excise Case No.1288 of 2018 registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 40 lts. of liquor form the market,his name transpired in the FIR and he succeeded in fleeing away. It further appears that the petitioner is accused in one more case.

Submission of the learned counsel for the petitioner is that Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.3722 of 2019(4) dt.22-02-2019 2/2 Having heard both sides and in view of the facts and circumstances, as well as allegation and criminal antecedent, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.

With the aforesaid observation, this application is dismissed.
