JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-07-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections 366, 302, 201/34 of the Indian Penal Code. Petitioner nos.1 and 4 are named whereas petitioner nos.2 and 3 are not named in the first information report. It is alleged that petitioner nos.1 and 4 along with others kidnapped the informant's daughter. Subsequently, the dead body of the informant's daughter appears to have been recovered near river. Submission on behalf of the petitioners is that no one has seen the actual killing of the deceased and moreover, having more or less similar allegation, co-accused Mahendra Bhuiyan and

Patna High Court Cr.Misc. No.29611 of 2016 (2) dt.26-07-2016 2/2 Kedar Bhiyan have already been granted privilege of bail by this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati (Gaya) in connection with Kothi P.S.
