JUSTICE PARTHA SARTHY ORAL ORDER 2 15-06-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Naugachiya P.S. Case No.160 of 2020 registered under section 30(a) and 38(1) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the FIR, it is stated that on information received from Karelal Mandal (petitioner herein), an accused in Naugachiya P.S. Case No.159/2020, a raid was conducted and a total of 117 litres of liquor was recovered from near the college.

It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and concocted. No incriminating article has been recovered from the person or

Patna High Court CR. MISC. No.12366 of 2021(2) dt.15-06-2021 2/2 possession or on information given by the petitioner. He is in custody since 23.5.2020 and investigation in the case has concluded.

Learned APP for the State has opposed the application for bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner being in custody for over 10 months, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Naugachiya P.S. Case No.160 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District-cumSpecial Judge, Bhagalpur.
