Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.
The allegation against the petitioner is that he gave tengari blow to injured whereas another co-accused,
Patna High Court CR. MISC. No.3679 of 2019(4) dt.29-03-2019 2/3 namely, Heera Sharma assaulted the injured.
Para 18 of the case diary goes to show that injured is said to have sustained three injuries and the concerned doctor has mentioned in the injury report that injured sustained grievous injury but it is surprising enough that said doctor did not mention as to which of the injuries was grievous in nature nor has mentioned that all the injuries of injured were grievous in nature. However, para 18 of the case diary also goes to show that injury report of injured has been issued by doctor of a private hospital.
Learned counsel appearing for the informant points out that bail prayer of co-accused Heera Sharma was rejected by a co-ordinate Bench of this court vide order dated 18.07.2018 passed in Cr. Misc. No. 41552 of 2018 but admittedly, the aforesaid co-accused Heera Sharma was granted bail by the same court on later stage. Therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned
