Petitioner seeks bail in a case under Section 302/34 IPC. The informant is not an eyewitness of the occurrence. He alleged that the petitioner along with Moinuddin Mian and Jogendra Nath were taking wine, which his father opposed immediately before death of the deceased.

It is submitted that on similar allegation, Moinuddin Mian has already been granted bailvide order dated 18.10.2012 passed in Cr.Misc. No.38219 of 2012. The case of the petitioner stands on same footing. Considering the facts that subsequent, the name of the petitioner figured in the case and that similarly situated co-accused has been enlarged on bail, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrte, Saran Chapra in connection with Revelganj P.S.Case No.82 of 2009.
