JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-04-2023 Heard learned counsel for the parties concerned. The present writ application has been filed by the petitioner seeking appointment on compassionate ground pursuant to death of his father in harness on 27.10.2019 while working as an Assistant Teacher in Government Middle School, Dohra, Anchal, Nawada, Distt. Nawada.

The petitioner duly applied as per the circular dated 9.7.2021 (Annexure-4) before the competent authority, but the

Patna High Court CWJC No.1968 of 2023(2) dt.17-04-2023 2/2 claim of the petitioner is still pending whereas the similarly situated persons have been recommended for appointment vide Annexure-8. Learned counsel next submits that the employment unit of the area in which the teacher was working is the competent authority to take a decision for appointment on compassionate ground.

The District Programme Officer vide Annexure-7 had called the petitioner along with other persons for verification of their testimonials and pursuant thereto, the petitioner appeared and produced all the documents.

In view of the fact that the claim of the petitioner is pending, the employment unit of Nawada is directed to take a decision upon the claim of the petitioner for compassionate appointment within a period of two months from the date of receipt/production of a copy of this order.

With this observation and direction, this writ application stands disposed of.
