JUSTICE BIRENDRA KUMAR ORAL ORDER 01-05-2018 Petitioners are permitted to correct the name of petitioner no. 3 in the bail petition in course of the day. Heard learned counsel for the petitioners and learned APP for the State.
Petitioners seek bail in a case registered for the offences punishable under Sections 417 and 420 of the Indian Penal Code.
Allegation is that some other candidates appeared impersonating themselves as petitioners in the physical test for
Patna High Court Cr.Misc. No.25870 of 2018 (2) dt.01-05-2018 2/2 appointment to the post of Constable.
Submission of the learned counsel for the petitioners is that cheating by impersonation is bailable. The petitioners are in custody since 23.02.2018. The investigation of the case is complete.
Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gardanibagh Police Station Case No. 52 of 2018, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
