JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 363, 366, 120B/34 of the Indian Penal Code. The victim has already been recovered and her statement under Section 164 of the Cr. P.C. was recorded. Although the victim stated that she was given intoxicated substance as a result whereof she became unconscious and when she regained her consciousness, she found herself at Delhi and after that she gave information to her father who came there and took her to her home but paragraph-15 of the case diary goes to show that petitioner and victim were caught by G.R.P. in suspicious condition and after that G.R.P. gave information to I.O.
Patna High Court Cr.Misc. No.24625 of 2016 (3) dt.18-07-2016 2/2 of the present case about recovery of the victim girl. Moreover, the Medical Board has found the age of victim between 17-18 years and it appears from perusal of the first information report itself that the relation of the victim with petitioner who was a student of 9th Class at the relevant time, was cordial and very sweet. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Gopalganj in connection with Mirganj P.S. Case No.367 of 2015.
