Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner, who is in custody, seeks bail in a case registered for the offence punishable under Sections 8/20(b)(ii) (C)/25/29 of the Narcotics Drugs and Psychotropic Substance Act.
Allegation is recovery of 517 Kg Ganja which was concealed in cabin of 407 vehicle.
Petitioner had earlier moved this Court for regular bail vide Cr. Misc. No. 34536 of 2018 which was rejected on 13.12.2018 with a direction to the trial court to conclude the
Patna High Court CR. MISC. No. 428 of 2020(3) dt.12-06-2020 2/2 trial within one year. Petitioner is innocent and has been falsely implicated in this case. Alleged Ganja was recovered from 407 vehicle whereas Petitioner was travelling in Xylo vehicle. Petitioner has no criminal antecedent and is in custody since 13.04.2018.
In view of recovery of huge quantity of narcotic substance, I am not inclined to enlarge the petitioner on bail at this stage, hence, the prayer for bail of the petitioner is hereby rejected.
However, trial court is directed to expedite and conclude the trial within one year from the date of receipt/production of a copy of order passed by this Court. (S. Kumar, J) veena/rajivU T
