The petitioner seeks regular bail in connection with Bhabua P.S. Case No. 372 of 2019 (Gr. No. 1459 of 2019), registered for the offence punishable under Sections 25(1-B), A/26 of the Arms Act.

The allegation is regarding recovery of one country made pistol and two live cartridges from beneath the sand after the petitioner had disclosed about the same to the police. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is submitted that since the petitioner is having a bad antecedent, he has been falsely implicated in the present case.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner, as also taking into account the period of incarceration, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabua in connection with Bhabua P.S.
