2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 504, 506 and 308 of the Indian Penal Code.

3. Prosecution case, in brief, is that this petitioner along with other co-accused persons assaulted informant and his two sons by lathi, danda and bricks as a result of which they sustained injuries.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Allegation of assault is general and omnibus and there is no specific allegation of overt act against petitioner. F.I.R. has been lodged after inordinate delay of three days which itself raises doubt over veracity of the prosecution case.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation and delay in lodging the F.I.R., this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Itarhi P. S. Case No. 224 of 2023, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
