JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2019 The petitioner apprehends his arrest in connection with Kasim Bazar P.S.Case No. 315 of 2017 registered under Sections 498A/34 of the Indian penal Code.

Allegation against the petitioner is of trying to set ablaze by sprinkling kerosene oil on the body of the informant and she managed to escape and motive behind the occurrence is that petitioner and others want to sell the shop situated at Kora Maidan which is in her exclusive share of the informant and due to raising objection the incident took place. Submission of learned counsel for the petitioner is that he is ready to keep the informant but she is not ready to go along with him.

From perusal of the impugned order also it appears that she is not ready to go with her husband's house rather she has

Patna High Court Cr.Misc. No.6668 of 2019(2) dt.05-02-2019 2/2 submitted that she is ready to go to her parental home. Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of copy of th is order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Munger in connection with Kasim Bazar P.S. Case No. 315 of 2017; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that petitioner shall co-operate in investigation as also in maintenance case, if any, filed by the informant before the competent court, otherwise informant is at liberty to move for cancellation of bail bond before the concerned court itself.
