====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 01-02-2023 Heard learned Senior counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code. Learned Senior counsel submits that this is the second attempt of the petitioner to seek anticipatory bail as earlier his anticipatory bail was rejected by order dated 28.11.2022 in Cr. Misc. No. 33876 of 2022. Learned Senior counsel next submits that the anticipatory bail of the petitioner was earlier rejected on the ground that he has assaulted the father of the informant by an iron rod causing injury on his head but the nature of injury by that time was not on record as the opinion was reserved. No.2942 of 2023(3) dt.01-02-2023 2/2 perusal of Annexure 4 to the present Anticipatory bail application it would manifest that supplementary injury report of Mahendra Rai was given on 09.12.2022 and from perusal of the same it would manifest that the injury was simple in nature caused by hard and blunt object.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned Senior counsel for the petitioner that the injury is simple in nature, the petitioner above-named the petitioner in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Goraul (Kathara) P.S. Case No. 426 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
