JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 02.09.2014 in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.

Petitioner is not named in the first information report nor anything has been recovered from his conscious possession and it appears that name of the petitioner has come in this case in confessional statement of co-accused.

The contention on behalf of the petitioner is that for the first time, petitioner was remanded in Ahiyapur P.S. Case No. 285 of 2013 and after that he was remanded in some other cases by the police without any cogent evidence.

Considering the aforesaid facts and circumstances as

No.6041 of 2015 (2) dt.13-02-2015 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Mithilesh Kumar, Judicial Magistrate 1st Class, Muzaffarpur in connection with Gaighat P.S.
